"In practice," Borges explains, "each small area that adopted an AI becomes responsible for everything involving the model: risks, performance, infrastructure, responsibility, ethics, legal parameters. Sometimes these areas don't even know these subjects exist."

Financial AI must comply with Basel III capital requirements, SEC trading rules, and anti-discrimination laws. When JPMorgan's AI makes lending decisions, it's bound by the Equal Credit Opportunity Act just like a human loan officer.11
Aviation AI faces perhaps the strictest oversight. Any AI system in an aircraft must meet DO-178C software standards—some of the most rigorous in the world.12
The "driver's seat" analogy - when on autopilot, who is responsible for an accident? We don't need entirely new legal frameworks just because the driver is silicon instead of carbon. Don't regulate "AI"—regulate high-risk applications. An AI choosing Netflix recommendations needs different oversight than one controlling insulin pumps. The EU's AI Act gets this right by creating risk tiers.
Outcome-Focused, Not Process-Prescriptive
Instead of dictating how AI should work, mandate what it must achieve. Set standards for accuracy, fairness, and safety, then let innovators figure out how to meet them. This is how we got catalytic converters instead of mandated engine designs.
Embrace Co-Regulation
Dr. Borges introduces a concept that deserves more attention: "Co-regulation is when companies, government, society, and academia come together to define standards and best practices. It's different from top-down regulation. It can be collaborative, practical, and possibly more aligned with market reality."
This isn't corporate capture—it's pragmatic governance. Companies understand the technology, academics understand the theory, government understands public interest, and civil society understands impact. Bring them together before problems emerge, not after.
Build Foresight Capabilities
"Few companies do what we research extensively here—monitor technology and regulation trends," Borges reveals. "You can make this part of planning routines: track what's happening with the EU AI Act, NIST frameworks in the US, and discussions in Brazil. If you know where things are heading, it's much easier to make decisions that will align later."
This applies doubly to regulators. They need teams that can anticipate technological evolution, not just react to yesterday's crises.
Create Regulatory Sandboxes
The concept has proven successful in fintech and deserves expansion. As Borges describes it: "It's like a testing environment where companies propose new solutions, regulators monitor, both learn, and from that create more realistic rules. It's regulating based on practice, not just theory."
The Innovation Imperative
Here's the uncomfortable truth: overregulating AI isn't just bad for innovation—it's bad for safety. When you force development underground or offshore, you lose visibility and control. When you slow legitimate researchers, you hand the advantage to bad actors.

But here's her crucial insight: "Technology isn't neutral. It carries values, interests, and affects power balance between people, companies, countries. One thing we should avoid—which happened extensively with the Internet—is leaving structural decisions in the hands of few companies with minimal supervision."
She references an intriguing concept from a UK professor: we're living in another of Gramsci's "eras of monsters"—the old world dying, the new being born, and in between, the monsters emerge. "With AI," Borges warns, "if we repeat this error, the damage could be much greater, because now we're dealing with systems that make decisions for us, or even in our place—and average people will let this happen easily, and even find it beautiful."

The answer isn't to strangle this technology in its crib with premature, fear-based regulation. Nor is it to let it run wild until catastrophe forces our hand. The answer is thoughtful, evidence-based governance that evolves with the technology it oversees.
We need regulations that act like guardrails, not roadblocks. Standards that ensure AI serves humanity without shackling human ingenuity. Oversight that promotes innovation within ethical bounds rather than innovation despite them.
But most importantly, we need to act with urgency on what Dr. Borges calls the "uncomfortable proximity" between technological power and political power. When a few companies control AI systems that shape global behavior, we're not just facing a regulatory challenge—we're facing a democratic one.
